OVERVIEW

These Terms of Service govern your access to Rootedintruth.co and your purchases from Rooted in Truth. Please read them carefully before using the website or placing an order.

Important: By visiting the website, creating an account, submitting content, or purchasing a product, you agree to these Terms. If you do not agree, please do not use the website.


1. ACCEPTANCE OF THESE TERMS

These Terms of Service (the "Terms") are a binding agreement between you and Rooted in Truth ("Rooted in Truth," "we," "us," or "our"). They apply to your access to and use of Rootedintruth.co, including its pages, content, features, communications, and online store (collectively, the "Services").

These Terms incorporate any policies posted on the website that apply to your activity, including our Privacy Policy, Shipping Policy, and Refund Policy. If a product listing or a written agreement with us contains terms that conflict with these Terms, the more specific terms control for that product or transaction.

You represent that the information you provide is accurate and that you have authority to agree to these Terms. If you use the Services for a business or other organization, you agree on behalf of that organization and represent that you are authorized to bind it.

2. ELIGIBILITY

You must be at least the age of legal majority where you live to enter into these Terms. A minor may use the Services only with the involvement and permission of a parent or legal guardian. The Services are not directed to children under 13, and children under 13 may not create an account or submit personal information through the Services.

You may not use the Services if applicable law prohibits you from doing so or if we previously suspended or terminated your access for violating these Terms.

3. CHANGES TO THE SERVICES

We may add, remove, update, suspend, or discontinue any part of the Services, product selection, or website functionality at any time. We do not guarantee that any product, feature, or content will remain available. Changes will not alter rights or obligations that already arose from an accepted order, except as allowed by law or agreed with you.

To the fullest extent permitted by law, we reserve the right to refuse service to anyone for any reason at any time. To the fullest extent permitted by law, we will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the Services.

4. PRODUCT INFORMATION

We work to describe and display products accurately. However, colors and appearance may vary because of screen settings, lighting, printing processes, materials, and natural or production variations. Images may show products in styled settings and may include frames, props, or accessories that are not included unless the product listing expressly says otherwise.

Measurements are approximate. Materials, packaging, and production methods may change when reasonably necessary, provided the resulting product remains materially consistent with the listing. If information on a listing conflicts with general website content, the listing controls for that product.

5. ORDERS AND ACCEPTANCE

Submitting an order is an offer to purchase. An automated order confirmation only acknowledges receipt; it does not necessarily mean that we have accepted the order. We may accept, reject, limit, or cancel an order for legitimate reasons, including product unavailability, suspected fraud, pricing or listing errors, payment problems, or shipping restrictions. We may, in our sole judgment, limit or prohibit orders that appear to be placed by dealers, resellers, or distributors.

Information on the Services may occasionally contain typographical errors, inaccuracies, or omissions, including in product descriptions, pricing, promotions, offers, shipping charges, transit times, or availability. We may correct any error, inaccuracy, or omission; change or update information; and cancel any order affected by inaccurate information at any time without prior notice, including after you submit the order.

If we cancel an order after payment has been captured, we will refund the canceled amount to the original payment method. We may limit quantities per customer, household, account, payment method, or order. Products may not be purchased for commercial resale unless we authorize that resale in writing or through an approved wholesale channel.

You are responsible for reviewing your cart and providing complete, accurate billing, shipping, and contact information. Please contact us promptly if you discover an error. We cannot guarantee that an order can be changed or canceled after production or fulfillment begins, particularly for made-to-order or personalized products.

6. PRICES, TAXES, AND PAYMENT

Prices are shown in the currency displayed at checkout and may change without notice. The price charged is the price shown when you submit your order, subject to correction of obvious errors. Shipping charges, taxes, duties, and other applicable fees will be displayed at checkout when available or assessed by the appropriate authority.

You authorize us and our payment service providers to charge the payment method you select for the total shown at checkout. You represent that you are authorized to use that payment method. We may require additional information to verify an order and may delay or decline an order if payment cannot be verified.

Promotions, discount codes, and gift offers are subject to their stated conditions, may not be combined unless expressly allowed, have no cash value, and may be changed or ended as permitted by law. We may correct or cancel a promotion used through fraud, error, or abuse.

7. SHIPPING AND DELIVERY

Available shipping methods, charges, destinations, and estimated delivery windows are shown at checkout or in our Shipping Policy. Processing and delivery dates are estimates, not guarantees, unless we expressly agree otherwise in writing. Delays may occur because of production schedules, carrier operations, weather, customs, incorrect addresses, or events outside our reasonable control.

Title and risk of loss pass as provided by applicable law and the selected carrier's terms. You are responsible for providing a secure, deliverable address and for any additional charges caused by an incorrect or incomplete address, refusal, or unclaimed shipment, except where law requires otherwise.

International customers are responsible for import duties, taxes, customs fees, and local import compliance unless checkout says otherwise. Customs may delay delivery.

8. RETURNS, EXCHANGES, AND REFUNDS

Returns, exchanges, cancellations, replacements, and refunds are governed by the Refund Policy posted on the website and any product-specific terms shown before purchase. Because some products may be made to order or customized, different rules may apply to different products.

Nothing in these Terms limits any refund, replacement, cancellation, warranty, or other right that cannot legally be limited. If an item arrives damaged, defective, or materially different from the order, contact us promptly using the instructions in the Refund Policy and retain the item and packaging until we advise you otherwise.

9. ACCOUNTS AND COMMUNICATIONS

If the Services allow you to create an account, you are responsible for maintaining the confidentiality of your credentials and for activity under your account. Notify us promptly if you believe your account has been used without permission. We may require reasonable verification before changing account information or releasing order details.

By placing an order, you consent to receive transactional communications such as confirmations, fulfillment updates, customer-service messages, and legally required notices. Marketing emails are optional. You may unsubscribe from marketing messages through the link in the email, but you may continue to receive transactional messages relating to an order or account.

10. ACCEPTABLE USE

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for lawful personal shopping and informational purposes. You agree not to: violate any law, regulation, court order, or third-party right; use the Services for fraud, harassment, abuse, deception, or unauthorized commercial activity; copy, scrape, crawl, index, harvest, or extract website content or data by automated means, except for ordinary search-engine indexing or with our written permission; interfere with security, access controls, networks, or the operation of the Services; introduce malicious code, attempt unauthorized access, or probe for vulnerabilities; impersonate another person, misrepresent your affiliation, or submit false information; circumvent purchase limits, access restrictions, or measures protecting content; use our products, content, name, or branding to train an artificial-intelligence system or create a competing commercial dataset without written permission; or assist another person in doing any of the above.

We may investigate suspected misuse and cooperate with lawful requests from authorities. Any enforcement action will be proportionate to the circumstances and subject to applicable law.

11. REVIEWS AND OTHER SUBMISSIONS

You retain ownership of reviews, photos, comments, suggestions, and other content you submit ("User Content"). You grant Rooted in Truth a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, adapt for formatting, publish, display, distribute, and use your User Content in connection with operating, improving, and promoting the Services and our products. This license lasts for as long as reasonably necessary for those purposes, subject to applicable law.

You represent that you own or have permission to submit the User Content and that our permitted use will not violate another person's rights. User Content must be truthful and must not be unlawful, defamatory, infringing, deceptive, obscene, threatening, discriminatory, invasive of privacy, or contain malicious code or another person's sensitive information.

We may moderate, refuse, or remove User Content that violates these Terms or is unrelated, fraudulent, or misleading. We are not obligated to publish any submission. If you believe content on the Services infringes your rights, contact us with enough detail for us to evaluate the concern.

12. INTELLECTUAL PROPERTY

The Services and their protectable content - including the Rooted in Truth name and branding, original artwork and design elements, product photography, graphics, text, layouts, selection and arrangement, and website presentation - are owned by or licensed to Rooted in Truth and are protected by applicable intellectual-property laws.

Except for the limited rights expressly granted in these Terms, no right, title, or interest is transferred to you. You may not reproduce, distribute, publicly display, sell, license, create derivative works from, or commercially exploit protected website content or product designs without our written permission.

Some products may incorporate Scripture passages, historical art, or other material in the public domain. Nothing in these Terms claims exclusive rights in an underlying public-domain work or Scripture text. Our rights apply to protectable original elements, branding, photographs, layouts, adaptations where protected, and the selection or arrangement of content. Purchasing a physical product does not transfer any copyright that may apply to its design.

"Rooted in Truth" and related names, logos, and trade dress may not be used in a way that suggests sponsorship, endorsement, or affiliation without permission.

13. PRIVACY

Our Privacy Policy explains how we collect, use, disclose, and protect personal information. By using the Services, you acknowledge the practices described in that policy. If these Terms conflict with the Privacy Policy on a matter involving personal information, the Privacy Policy controls for that matter.

You are responsible for ensuring that information you provide about another person, such as a gift recipient's shipping address, is shared lawfully and with appropriate permission.

14. THIRD-PARTY SERVICES AND LINKS

We may use third parties to provide hosting, payments, analytics, communications, production, fulfillment, shipping, reviews, or other functions. Third-party services may be governed by their own terms and privacy policies. We are not responsible for a third party's independent acts, content, security, availability, or policies, except to the extent applicable law makes us responsible.

Links to third-party websites are provided for convenience and do not imply endorsement. Your dealings with a third party are between you and that third party. Please review its terms before using its services.

15. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND WEBSITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." ROOTED IN TRUTH DISCLAIMS ALL WARRANTIES NOT EXPRESSLY STATED IN THESE TERMS OR A PRODUCT LISTING, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant that the Services will always be available, secure, accurate, complete, or error-free, or that defects will be corrected immediately. Website content is provided for general information and inspiration and is not professional, legal, medical, financial, or pastoral advice.

Some jurisdictions do not allow certain warranty exclusions. In those jurisdictions, these exclusions apply only to the extent permitted, and you retain all non-waivable consumer rights.

16. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, ROOTED IN TRUTH AND ITS OWNERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY; OR THE COST OF SUBSTITUTE SERVICES ARISING OUT OF OR RELATED TO THE SERVICES, PRODUCTS, OR THESE TERMS, EVEN IF ADVISED THAT SUCH DAMAGES WERE POSSIBLE.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM A PRODUCT, ORDER, OR USE OF THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ROOTED IN TRUTH FOR THE PRODUCT OR ORDER GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

These limitations do not apply to liability that cannot legally be limited or excluded, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law so provides. The limitations apply regardless of the legal theory and are an essential basis of the agreement between you and Rooted in Truth.

17. INDEMNIFICATION

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Rooted in Truth and its owners, employees, contractors, and service providers from claims, damages, losses, liabilities, and reasonable expenses arising from your material violation of these Terms, your unlawful misuse of the Services, or User Content that infringes another person's rights.

We will provide reasonable notice of a covered claim and may control its defense and settlement. You may not settle a claim in a way that admits fault by or imposes an obligation on Rooted in Truth without our written consent.

18. SUSPENSION AND TERMINATION

You may stop using the Services at any time. We may suspend or terminate access, cancel an account, or refuse future service if we reasonably believe you violated these Terms, created risk or legal exposure, engaged in fraud or abuse, or used the Services in a way that harms customers, third parties, or Rooted in Truth.

Termination does not affect obligations that arose before termination. Provisions that by their nature should survive - including payment obligations, intellectual-property provisions, disclaimers, limitations of liability, indemnification, dispute terms, and general provisions - will survive.

19. GOVERNING LAW AND DISPUTES

These Terms and any dispute arising from them or the Services are governed by the laws of the State of Wisconsin, without regard to conflict-of-law principles, except where the law of your residence must apply.

Before filing a formal claim, you and Rooted in Truth agree to make a good-faith effort to resolve the dispute informally. Send a written description of the issue, the order number if applicable, and the relief requested to the contact below. If the dispute is not resolved within 30 days after receipt, either party may pursue available legal remedies.

Subject to any non-waivable right to bring a claim elsewhere, you agree that disputes will be brought in a state or federal court of competent jurisdiction in Wisconsin, and you consent to that court's personal jurisdiction. Either party may bring an eligible individual claim in small-claims court. Nothing in this section prevents either party from seeking urgent injunctive relief to protect intellectual-property or data-security rights.

20. CHANGES TO THESE TERMS

We may update these Terms from time to time. The revised Terms will be posted on the website with a new effective date. Changes apply prospectively when posted or on a later date stated in the update. If a change materially affects existing users and applicable law requires notice, we will provide notice by reasonable means. Continued use after the revised Terms take effect means you accept them.

21. GENERAL PROVISIONS

These Terms and the policies incorporated into them are the entire agreement between you and Rooted in Truth concerning the Services, except for any separate written agreement that applies to a specific transaction. If a provision is unenforceable, it will be modified only as much as necessary to make it enforceable, or severed if modification is not possible; the remaining provisions remain in effect.

Our failure to enforce a provision is not a waiver. You may not assign these Terms without our written consent. We may assign them in connection with a merger, sale, reorganization, or transfer of the business or its assets. Headings are for convenience only. "Including" means "including without limitation."
